The American Fintech Council (AFC), an industry association representing fintech and banks, has expressed its support for the Fair Audits and Inspections for Regulators’ (FAIR) Exams Act. The bipartisan legislation, introduced by US Senator Jerry Moran and co-sponsored by Senators Joe Manchin, Bill Hagerty, and Thom Tillis, aims to enhance transparency and accountability in bank examinations. The FAIR Exams Act proposes establishing an independent review and appeal process to resolve disagreements between banks and regulators, hiring an independent director to review disputes, and requiring timely responses to bankers during exams. The AFC has consistently advocated for a clear and consistent regulatory framework that reflects industry developments.
